What is plagiarism from a legal perspective?
Plagiarism is one of the most common and controversial violations of copyright law. In the Polish legal system, the concept of plagiarism has not been defined by law, but is widely discussed in case law and doctrine. In the U.S., the key issue of copyright infringement is "substantial similarity," or substantial similarity between works.
U.S. courts evaluate not only the sameness of the content, but also whether the average viewer could recognize one work as a copy of another.
